Paroled B.C. sex offender who grabbed kid at pool will see orders expire in fall

A Lower Mainland sex offender, who committed further offenses while on parole, will have his special conditions prolonged, but only until November, when his supervision order expires, according to a June 13 Parole Board of Canada decision.

Jerry Jaromir Dvorak’s case manager sent the board a recommendation to maintain the condition that Dvorak reside in a specific place until November, when his parole (a 10-year Long Term Supervision Order) expires.

The manager considers Dvorak a high risk to reoffend sexually, noting, among many relapses, an encounter with a young child in a public pool.

Dvorak spent 10 years in prison, from 2003 to 2013, for sexually assaulting a sex worker with a weapon, in 1992, in Surrey. Dvorak was initially designated a dangerous offender but successfully appealed his conviction until being retried and found guilty again.

Dvorak, 62, has “a lengthy criminal history of personal harm offences that started in 1979,” the decision noted.

“You are described as being the ‘mastermind’ behind a number of planned sexual assaults against women. You and an accomplice planned two separate sexual assaults of sex trade workers, which you perpetrated while intoxicated. On another occasion, while on bail, you used a knife to kidnap, rape and forcibly confine a teenage girl in a car for two hours after you found her waiting for a ride outside of a hospital,” stated the decision.

In 2013, Dvorak began his 10-year supervision order. In 2016, Dvorak’s order was suspended for 12 months after he was found to have purchased and consumed alcohol.

In 2019, Dvorak was arrested for an unprovoked assault of a man with an extendable antenna (sending the victim to the hospital); he had fled the scene and when police caught him he failed a roadside screening twice. He was convicted of assault with a weapon.

In 2021, Dvorak was alleged to have touched a six-year-old’s bum, grabbed the child’s leg and "hugged" the child at a public pool. The mom called the police, according to the decision.

“You were in breach of your condition prohibiting you from being in the presence of female children under the age of 18. You pled guilty to Breach of LTSO and sentenced to one day time served with probation. The Sexual Inference charge resulted in a Stay of Proceeding,” noted the decision.

Dvorak has residency conditions placed on him and this month’s decision is understood to be the third extension of those conditions — to reside at a community residential facility.

“The Board finds the most recent conviction related to being in the presence of female children under 18 and the subsequent police investigation related to your contact with a six-year-old child, demonstrates the ongoing concerns related to the insight and understanding you have with regard to your decision making, problem solving and general internalization of the skills and tools needed to manage you risk.

“The Board notes you remain assessed a high risk to reoffend sexually,” stated the decision.

But, the board also noted Dvorak has recently demonstrated “an excellent attitude” toward a sex offender program, while at the facility.

This, despite the decision also noting Dvorak also was “observed meeting two women outside a residence that housed vulnerable women” in November 2022.

As a result of his upcoming release, Dvorak was granted leave privileges to help build family and community supports.
